Dispute Resolution Experience

If a matter is referred to Court or the Lands Tribunal, Howard is able to either act as a Party Appointed Expert or a Single Joint Expert. He has acted on cases that have been to the High Court and the Lands Tribunal and is used to being cross-examined.

Through the Academy of Experts, He is a Qualified Dispute Resolver (QDR number 293) and was entered on the Register of Qualified Mediators in 2005. In 2005, I undertook the Academy of Experts' Mediation Training Programme and became accredited, subsequently dealing with mediation cases through the Court Mediation Scheme initially at the Central London Civil Justice Centre.

Whilst obviously well placed to assist with property related cases, especially in the leisure sector, as a Mediator, Howard can in theory deal with any type of commercial dispute.

He has developed his mediation role further by becoming an RICS Accredited Mediator in 2009 and has joined up with other property mediators to be on the panel of the Dispute Mediation Consultancy.

In 2006, Howard was appointed an Associate of the Chartered Institute of Arbitrators and in 2009, I was appointed a full Member following successful completion of their Advanced Certificate in Arbitration. Prior to this, he was appointed onto the RICS President's Panel of Arbitrators in June 2008. He is available to act as an arbitrator in cases where his knowledge and experience is relevant.

Howard is an Accredited Associate of the Dispute Mediation Consultancy and member of the RICS Mediators group.

Mediation Experience

Whilst obviously well placed to assist with cases in the leisure sector (e.g. public houses, bars, restaurants, clubs, hotels, cinemas and other urban leisure), and other property sectors where he has significant knowledge (e.g. Care and Medical), he can deal with a variety of mediations involving a wide range of property related issues and commercial disputes.

Experience

Howard is a Chartered Surveyor with 30 years experince and has been an accredited mediator for circa 10 years.

Originally accredited by the Academy of Experts in March 2005 (QDR) and subsequently accredited as a mediator by the RICS, mediations have been undertaken covering a wide range of commercial disputes.

Mediations have included:-

  • Commercial and residential property disputes
  • Partnership disputes
  • Insurance disputes
  • Finance disputes
  • Motor vehicle disputes

As a surveyor working within the leisure property sector, Howard has a broad experience of issues involving property, contract, corporate structure, ownership, insurance, staff et al. 

He is able to grasp the issues that are important to the parties, thereby making him an effective mediator.
