Scope:
Learning to represent your business or others at civil / commercial mediation
Objective:
Understanding Mediation from the professional representative's standpoint. What is different about being an advocate in mediation. The role and various tasks. Preparation. Dealing with the mediator before and during the process. Managing expectations.
Content:
In addition to the contents of the Mediation Awareness course, this course deals with practical matters including:
- Exchange of information / case summary;
- Choosing the right Mediator and Venue;
- Authority to settle;
- marshalling your team - preparing each participant;
- dealing with the Mediator in the pre-appointment phase including preliminary communications between all concerned;
- Tactical considerations of the parties; preparing for the Opening and Private and Open Sessions;
- Working towards a settlement;
- Effective mediation management;
- Negotiation Processes and Strategies within Mediation;
- The Momentum to Expect;
- Dealing with lawyers;
- Ensuring the settlement agreement is viable.
